Aba Attendance Requirements
Schools are free to set standards that they believe are consistent with this policy. including the statement that participation in 10% of the lesson is sufficient to meet their requirements, or that the student must attend 100%. Before I started 3L, I decided to calculate my potential graduation GPA, academic level, and honors. If I received all the A`s, I would be of the same rank and the same. all the D`s and I would be of the same rank and the same laud. What was the motivation to participate? One of my classes met 4 days a week for 2 hours each.
Not being present saved me 8 hours of my life a week. I spent most of my time in a part-time company that allowed me to get a job after law school at a government agency I love. Other times I was at a popular happy hour spot and took my hat off to other classmates who openly skipped this scary class. I had a class where the teacher required a strict presence. I tried to exhaust them by taking extremely conservative positions when I was asked to do so and/or questioned their scholarship. I still got an A in this class by taking the outline of a classmate with tabs in the final. In short, the year 3L was a bit like Sparta. Those who followed all the rules starved to death without a job.
Those of us who skipped classes did important networking at happy hour and landed jobs. My school has always said that there is an attendance policy, that their honor code is based on aba requirements. They said attendance was based on the number of credits the class was and the number of hours per week it filled. Later, I discovered that it was actually necessary for teachers to be available for a certain number of hours per credit, so if a class is cancelled, you don`t really need to go to makeup, the teacher just needs to be in the classroom and ready to teach makeup. When I read the ABA`s accreditation rules years ago, they struck me as a set of rules designed to limit law school to people from relatively wealthy backgrounds. Attendance, residence, all these rules require adults to devote three years full-time to school. Today, of course, law school is too expensive for everyone – tuition is simply too high. But it`s worth thinking about what we`ve been doing with these rules for a very long time. Not only are the attendance rules infantilizing and pedagogically offensive (I refuse to require people to attend a large teaching class if I can`t do something useful enough during that class time to let them come voluntarily), but they are also part of a larger model that has always made legal education more expensive than it should be.
Previously, the standard was in 304, which required schools to publish guidelines that require “regular and timely attendance” and provide ways to implement these policies. If a student is found to be in violation of any of these requirements, the faculty member or the Rules and Petitions Committee may refuse student credit in the classroom, revoke the student`s privilege to be a member of the law school, and add a memo or other appropriate action to the student`s file. My school claims that there is an attendance policy issued by the ABA, where we can only miss 20% of classes and we go around a registration sheet. Do other law schools submit an application form? It is the professors who take on the role, but they rarely bother to do so. I have had several 1L teachers who never took on a role, and as might be expected, some students rarely attended classes during the 1L year. As you pointed out, most professors don`t even know the ABA`s attendance rules, let alone try to track attendance. This, in turn, only supports your view of law schools. Students don`t care about the material and professors don`t care about attendance or whether or not students are using the material. Education is a secondary or tertiary concern. Tuition money comes into play, no matter if 1 student or 90 students attend the lessons. Most professors don`t even require students to read every week, they only select a few students per course to be on call. Normally, this would be quite troubling, but since most law courses don`t teach anything valuable, it`s just the status quo. If you select comments/posts on TLS, you are doing a disservice to student representation and legal education as a whole.
Of course, anonymous students will have an online pee contest about how little work they do. There is work to be done to reform the Grade 3 program, some of which you yourself have reasonably satisfied, but this particular example is completely unfair. Most universities and colleges have compulsory attendance, even if it is not recorded with the same accuracy as high school attendance. .
