The good news is that there are several viable reasons you can present to your landlord to explain why a tenant transfer agreement would also be in their best interest. A delivery of the rental agreement does not need to be made in writing (although we strongly advise against it). In this case, the landlord and tenant will take steps that signal their joint intention to terminate the lease. According to the California Department of Consumer Affairs, if you leave an apartment before the lease expires, the landlord may have the right to ask you for rent for the remainder of the rental period. Landlords have the right to enter the premises without notice of the intended entry if the tenant has left or abandoned the premises. Under California Civil Code 1951.3, landlords may consider an abandoned property and take steps to withhold personal property if rent remains unpaid for 14 consecutive days or if the tenant provides written notice of the handover of the property. Express delivery involves the use of a written agreement (or statement) to hand over the rental. Express delivery is by certificate. Since mutual consent is required, both the landlord and tenant must sign the agreement. Both signatures must be attested. Once the agreement is signed, both parties will be released from all future obligations to each other. The tenant must continue to pay the rent until the landlord agrees to the waiver (subject to the natural expiry of the lease).
Note that the written agreement must clearly indicate that it is an act and that the lease ends with immediate effect. As a tenant, there are several reasons why you may want to break your lease. If there are subtenants on the property, they must continue to stay on the property under the same conditions. The essence of tacit delivery is the consensual transfer of ownership of the premises to the owner by the tenant. The landlord`s belief that the tenant has renounced the property must therefore be genuine, that is, there are indications that the tenant has removed all signs of his occupation, including furniture and things. If the proof of surrender by the tenant is not clear, the landlord runs the risk of illegally evicting the tenant. The agreement must specify the date and time when the property is officially returned to the owner and in what condition. It should also include all financial conditions required by one or both parties at the time of delivery. Both parties sign the agreement, hand over the keys and the rental ends.
